Abstract:China’s four big state-owned banks all have raised cross-bank ATM fee. However,China’s “Anti-monopoly Law”,in principle,forbids operators’ abuse of their dominant market position. Whether an operator is abusing its dominant market position is judged from whether the operator has a dominant market position,whether it has abused or is abusing its dominant position,whether there is any damages and whether there is a cause-effect relation between abuse and damages. According to the “Anti-monopoly Law”,anti-monopoly law enforcement agencies investigate,affirm,penalize and publicize suspected abuse of dominant market position. China should keep on amending its law so that individuals can accuse operators for abusing dominant market position,for checking such abusive behavior can better maintain the market competition,increase economic efficiency and realize the maximization of consumers’ benefits.
